1. Acceptance of Terms
By accessing or using any services provided by RecoverPain (“we,” “us,” or “our”), including our website, mobile applications, or any other digital platforms (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of our Services. If you do not agree to these Terms, you must discontinue the use of our Services immediately.
2. Services Provided
RecoverPain offers coaching services focused on wellness and pain coaching, delivered primarily through virtual platforms such as Zoom. These services are intended for educational and general wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment, nor should they be used in place of advice from a licensed healthcare provider. Please consult with your healthcare professional for any medical concerns.
Our coaches may not be licensed healthcare professionals in the state, country, or jurisdiction where you are located. The information provided during coaching sessions is for general wellness purposes only and does not constitute medical care, physical therapy, or any other healthcare service that would require a specific license in your location.
The client understands and agrees that RecoverPain is not, nor is it comprised of, owned by, or managed by, a medical doctor, a physical therapist, or any other individual or entity holding a license to practice medicine, physical therapy, or any similar healthcare profession in any jurisdiction, including but not limited to any of the fifty (50) U.S. states. The client further acknowledges that while our coaches may hold professional licenses in their jurisdictions, these licenses do not authorize them to provide medical care or treatment in your jurisdiction.
If the client has any questions or concerns about their health or medical needs, they are advised to consult with a licensed healthcare provider in their own jurisdiction immediately. Furthermore, the client releases RecoverPain from any and all liability and responsibility for injuries, death, or losses resulting directly or indirectly from the services. The client acknowledges that they are partaking in the services at their sole and exclusive risk and bear full responsibility for the consequences of any actions, or failures to act, that occur during or in connection with the provision of the services by RecoverPain under this agreement, as well as any directions expressed or implied by RecoverPain during the provision of the services.
Additionally, any nutritionists or similar professionals providing services under RecoverPain may not be licensed in the United States or your specific location, and their advice is intended for general wellness purposes only. It is not intended to replace the advice of licensed healthcare providers and you should look for nutritionists or similar professionals in case you require assistance.
2.1 Definition of Pain Coaching
Pain Coaching:
Pain Coaching refers to a range of support and educational services designed to help clients improve their wellness, particularly in relation to pain. These services may include:

Support Services: Providing emotional and motivational support to help clients cope with pain and its impact on daily life.

Educational Services: Offering information and guidance, lifestyle adjustments, and general wellness practices in relation to pain.

Personal Training: Delivering personalized exercise plans and physical activity recommendations aimed at improving overall wellness and managing pain. These exercises are provided within the scope of general wellness and are not intended as physical therapy or medical treatment.

Goal Setting: Helping individuals set realistic goals for pain management and overall well-being.
Pain Coaching is intended to empower clients to take an active role in their own wellness journey. It is not a substitute for professional medical advice, diagnosis, or treatment. Clients are encouraged to consult with licensed healthcare providers for any medical concerns.
3. Eligibility
Our Services are intended for individuals who are at least 18 years of age. By using our Services, you represent and warrant that you meet this age requirement. If you are under 18, you must have the written consent of a parent or legal guardian to use our Services.
3.1 Call Recording for Quality Purposes
Call Recording:
To help us improve our services and ensure the best experience for our clients, you agree that we may occasionally record calls or virtual sessions with our coaches, contractors, or team members. These recordings are used for quality assurance and training purposes. We store them securely and only allow access to authorized team members. If you’re not comfortable with this, just let us know before your session starts. By using our services, you’re agreeing to this practice, but we’re always happy to accommodate your preferences.
4. User Responsibilities
You agree to provide accurate, current, and complete information as required for the use of our Services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to comply with all applicable laws and regulations when using our Services and understand that you are solely responsible for your use of the Services.
4.1 Prohibited Uses
You may use RecoverPain only for lawful purposes and in accordance with these Terms. You agree not to use RecoverPain:

In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the U.S. or other countries).

For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.

To send, knowingly receive, upload, download, use, or re-use any material which does not comply with these Terms.

To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

To impersonate or attempt to impersonate RecoverPain, a RecoverPain employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).

To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of RecoverPain, or which, as determined by us, may harm RecoverPain or users or expose them to liability.
If we reasonably suspect that your RecoverPain Account has been used for an unauthorized, illegal, or criminal purpose, you give us express authorization to share information about you, your RecoverPain Account, and any of your transactions with law enforcement.
5. Payment and Refunds
All payments for Services must be made in advance unless otherwise agreed upon in writing. We accept payments through credit card, PayPal, crypto, or other payment methods as specified on our website. All fees are non-refundable except as required by law or as specified in our refund policy. In the event of a payment dispute, you must notify us within 10 days of the transaction.

6. Limitation of Liability
Injuries, Death, and Extreme Consequences:
To the fullest extent permitted by law, RecoverPain, its officers, directors, employees, contractors, and affiliates shall not be liable for any injuries, death, or extreme consequences resulting from your participation in or reliance on the Services provided. You acknowledge that participation in these Services carries inherent risks, and you accept full responsibility for any and all consequences that may arise from your involvement.
7. Contractor Liability and Company Responsibility
Any claims, disputes, or legal actions brought by a client or third party against any contractor, employee, or affiliate of RecoverPain, arising out of or related to the services provided, shall be the ultimate responsibility of RecoverPain. The client agrees and accepts that any such claims will be directed towards RecoverPain as the responsible entity, and not towards individual contractors, employees, or affiliates. RecoverPain assumes all legal responsibility for the actions and services of its contractors, employees, and affiliates, within the scope of their work for the company.
8. Governing Law and Jurisdiction
These Terms and any other agreement signed between RecoverPain and any other party shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Slovenia for the resolution of any disputes arising out of or relating to these Terms or the Services provided by RecoverPain.
9. Intellectual Property
All content and materials available on our website and through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the property of RecoverPain or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content obtained from our Services without our express written permission.
9.1 Trademarks
The RecoverPain name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of RecoverPain or its affiliates or licensors. You must not use such marks without the prior written permission of RecoverPain.
10. Termination
We reserve the right to terminate or suspend your access to our Services, without notice, for any reason, and for any conduct that we believe violates these Terms, is harmful to other users of our Services, or is otherwise inappropriate, in our sole discretion. Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect.
11. Changes to the Terms
We may update or modify these Terms from time to time. Any changes will be effective immediately upon posting on our website. Your continued use of our Services after such changes have been posted constitutes your acceptance of the revised Terms.
